PESHAWAR, October 13: The Peshawar High Court (PHC) has restrained the provincial government from dividing Kohistan district into two parts.
Hearing a case filed by a former nazim Haji Amir Zada, his lawyer told the court that the provincial government had decided to divide the area into Upper and Lower Kohistan districts.
He said the decision was unlawful because the Lower Kohistan has been given Patan, Dubair, Doryal, Sewan and Kamlia area, which are tribal areas falling under the federal government jurisdiction but that the provincial government had merged these areas into the settled region.
The court asked the provincial government not to divide Kohistan and sought assistance of the attorney general and Khyber Pakhtunkhwa advocate general with regards to the provincial government’s authority on formation of new districts.
The decision to divide Kohistan into two parts had been taken in January this year.
