Draft Amendment Tightens Cybercrime Law to Combat Fake News, Establishes New Authority

Islamabad – The federal government has prepared a draft of the Prevention of Electronic Crimes (Amendment) Act, 2024, aimed at tightening regulations on social media to curb the spread of fake news. The proposed amendments suggest stringent penalties, including up to five years of imprisonment or a fine of Rs. 1 million for individuals found guilty of disseminating false information.

Establishment of Digital Rights Protection Authority

The draft introduces the creation of a Digital Rights Protection Authority, composed of a chairman and six members. This authority will have the power to block or remove online content and issue directives for the removal of material deemed harmful or threatening. Appeals against the authority's decisions can be made to a designated tribunal.

The authority will have broad powers to order the removal of content that promotes hatred against the state, threatens public order, or involves defamatory or pornographic material. It will also be empowered to direct law enforcement agencies to act against those who spread terror-inducing content.

Background of Cybercrime Legislation in Pakistan

Pakistan's first legal framework for cybercrime was introduced with the Electronic Transactions Ordinance (ETO) in 2002, which addressed a limited range of offenses. 

In 2016, the Prevention of Electronic Crimes Act (PECA) was enacted, providing comprehensive provisions for the investigation, prosecution, and adjudication of electronic crimes. The current draft seeks to expand and strengthen PECA to meet the evolving challenges of the digital era.

Anti-Riot Force to Address Civil Unrest

Separately, during a meeting chaired by Prime Minister Shehbaz Sharif, it was decided to form an international-standard anti-riot force to manage civil disturbances effectively. This decision came after the recent unrest in Islamabad during the Belarusian President’s official visit, which the Prime Minister termed a national embarrassment.

The Prime Minister emphasized that those involved in damaging public property or violating the law during protests would face legal consequences. Weekly reviews of legal action against such individuals will be conducted.

Moreover, efforts are underway to enhance the Safe City Islamabad project by establishing a forensic lab that meets international standards, and utilizing all necessary resources to ensure its effectiveness.
